Event Terms & Conditions

These terms and conditions (these “Terms”) apply between you and Joy Square Limited (“Joy Square”, “JSL”,“we”, “our” or “us”), the organiser of the 1.5°C Summit 2024 (the “Summit”) and a subsidiary of New World Development Company Limited (“NWD”). Joy Square is part of or associated with the New World group of companies including NWD and its affiliated, associated or related companies from time to time (collectively the “New World Group”).

The Terms herein apply to your registration and/or attendance at the Summit, whether physically and/or digitally. Please read these Terms carefully as they contain important information.

By registering and/or attending the Summit, whether physically and/or digitally, you shall be deemed to have read, understood and agreed to be bound by these Terms. If you do not agree to be bound by these Terms, please do not register or attend the Summit.

1. The Summit will be held physically and digitally on 25 October 2024 from 10:00 am to 5:15 pm (Hong Kong time). For physical attendance, the Summit will be hosted at 6/F, K11 MUSEA, Tsim Sha Tsui, Hong Kong. For digital attendance, the Summit will be conducted by way of video live streaming (the “Live Streaming”) broadcasted through the Platform (as defined below) of EventXtra Limited (“EventX”), our external service provider. 

2. The Summit will include a variety of activities (the “Activities”), including but not limited to thought leadership forums, exhibitions by our exhibitors, pitching, dialogues with practitioners, speeches by guest speakers, discussion sessions, networking events, etc.. For the avoidance of doubt, depending on the nature of each Activity, some of the Activities will only be available for attendees joining the Summit physically or selected attendees.

3. Details regarding the Summit, including the agenda, are set out at the Summit’s official website (the “Website”): https://onepointfivesummit.com/. All information listed in the agenda is for reference only. 

1. If you wish to attend the Summit, please complete and submit the online registration form for the Summit (the “Registration Form”) hosted on the designated platform of EventX (the “Platform”). No registration fee is required.

2. EventX is representing us to handle the coordination, registration, quota allocation, communication, etc. for the Summit. You are not required to create an account with EventX or log into such account (if applicable) for accessing and/or submitting the Registration Form although you may elect to do so at your own choice. By submitting the Registration Form, you shall be deemed to have agreed to all terms of EventX’s terms & conditions (https://eventx.io/terms-of-service/) and privacy policy (https://eventx.io/privacy-policy/) (collectively the “EventX Terms”), which shall form part of these Terms. In case there is any conflict between the EventX Terms and these Terms, we shall have the absolute discretion to determine which term shall prevail.

3. Registration to the Summit is only open for individuals aged eighteen (18) or above. You must confirm that you are aged eighteen (18) or above when submitting the Registration Form. 

4. Admission quota for attending the Summit physically is limited, which will be allocated on a first-come, first-served basis, based on the time of receipt of the completed Registration Form as shown on EventX’s electronic record. Completion and submission of the Registration Form does not warrant, represent or guarantee a successful allocation of admission quota to the Summit physically. There is no quota for attending the Summit digitally. Subject to these Terms, all persons (a) confirming to be aged eighteen (18) or above, (b) submitting the Registration Form and (c) meeting the relevant criteria (if any) will be eligible to attend the Summit digitally.

5. Information provided through the Registration Form cannot be modified upon submission.

6. You shall ensure all submitted information provided in the Registration Form are genuine, correct and complete. We and/or EventX will not be responsible for any delay, loss, errors or unrecognisableness of the information submitted by you due to technical issues such as computer or network problems.

7. We have the right to invalidate and nullify any registration without prior notice if (a) there are any inaccuracies or omissions in the submitted information, (b) the Registration Form is incomplete or with outstanding information, (c) the registration has been made by way of dishonest attempts or by any other methods intruding or tampering computer programmes and/or (d) there is any fraudulence, and we reserve the right to take legal actions against any violations.

8. After submission of the Registration Form, if your registration is successful, you will receive a confirmation email to be sent by the EventX system (the “Confirmation Email”). If you are being allocated an admission quota to attend the Summit physically, the Confirmation Email will contain a unique and designated entrance QR code for the Summit (the “Entrance Code”). 

9. The Confirmation Email will also contain a unique and designated link to the Platform for the Live Streaming (the “Live Stream Link”) with your registration details visible under the “My Registration” tab.

10. Where applicable, the admission quota to the Summit, the Entrance Code and the Live Stream Link are personal to you as a registered registrant and non-transferrable. You shall not share your Entrance Code, Live Stream Link and/or any other access credentials with others.

1. Where applicable, for attending the Summit physically, you shall arrive at the Summit venue anytime during the Summit time and conduct check-in by showing the Entrance Code to our personnels or helpers. We reserve the right to inspect your identification documents on the day of the Summit to verify your name and/or age. We have the right to refuse admission to the Summit physically by any persons who fail to register successfully, provide the Entrance Code or satisfy the relevant eligibility.

2. Access control may be implemented for the purpose of crowd management in respect of physical attendance to the Summit. In such circumstances, you shall follow the instructions of our personnels or helpers.

3. You will be provided with a name badge containing your personal information and your personalised QR code (the “Name Badge”) upon check-in, which is personal to you and non-transferrable. The Name Badge shall be conspicuously presented when entering the Summit venue and must be worn and shown clearly by you at all times during the Summit.

4. You may be asked to have the QR code on your Name Badge being scanned prior to joining any Activity(ies) at the Summit for attendance record purpose. There will not be any transfer of your personal information from us to any third parties merely by scanning of the QR code on your Name Badge.

5. You may voluntarily elect to directly provide your personal information to an exhibitor or any other entity at the Summit physically, which will be subject to that entity's applicable privacy policy and personal information collection statement (if any), and we are not involved in such process. [For the avoidance of doubt, the exhibitor or other entity at the Summit are independent from Joy Square and/or the New World Group, unless indicated otherwise.]

6. Any food and beverages served at the physical Summit are provided by third-party service provider. Your consumption of such food and beverages shall be at your own risk and we shall not be liable for any matters, circumstances and/or liabilities relating to, arising from and/or connected with your consumption of such food and beverages.

7. You are required to take care of your own personal belongings and properties brought to the Summit, while we advise you not to bring along any valuable items. We shall not be responsible for any damage or loss of your personal belongings and properties that may occur during your participation of the Summit, regardless of the cause.

8. Any complimentary gift item(s) (if any) distributed to you during the Summit are not manufactured or supplied by us. We take no responsibility and assumes no liability whatsoever in relation to any obligations or liabilities in connection therewith. We do not warrant that any such item(s) are of any merchantable quality or fit for any purposes. You shall waive all rights and interests, if any, of any nature to pursue against us in relation to any such item(s).

1. Where applicable, for attending the Summit digitally, you shall be able to view the Live Streaming on the Platform by clicking the Live Stream Link anytime during the Summit time. You are not required to create an account with EventX or log into such account (if applicable) for viewing the Live Streaming although you may elect to do so at your own choice. By clicking the Live Stream Link and/or viewing the Live Streaming, you shall be deemed to have agreed to the EventX Terms, which shall form part of these Terms. In case there is any conflict between the EventX Terms and these Terms, we shall have the absolute discretion to determine which term shall prevail.

2. We may, through EventX, track your actions conducted during the Live Streaming and such tracking data will be used by us in accordance with the relevant provisions set out in our Personal Information Collection Statement in respect of the Summit (https://www.onepointfivesummit.com/pics) (the “PICS”), which you have provided your consent at the Registration Form.

1. The Activities held at the Summit and the contents thereof are prepared and/or presented by the relevant exhibitors and/or speakers, and do not represent the position of Joy Square or any entities under the New World Group, unless indicated otherwise. 

2. We (or any entities under the New World Group) are not liable for any views or contents expressed or given by any exhibitors and/or speakers during the Summit or in any materials provided to you. We (or any entities under the New World Group) take no responsibility and assumes no liability whatsoever in relation to any obligations or liabilities in connection therewith.

3. The contents of the Activities and the Summit are not intended to amount to advice on which you should rely on. You shall obtain professional or specialist advice before taking, or refraining from, any action or inaction on the basis of the contents of the Activities and the Summit.

4. There are no representations, warranties or guarantees that the contents of the Activities and the Summit are accurate, complete or up-to-date at all times. We shall not be responsible, or liable to any party, for the contents or accuracy of any such contents.

1. The following materials are prohibited from the Summit:
   a) illegal items, substances or materials;
   b) any materials with political, racial, religious or offensive messages;
   c) any unauthorised materials for trading, marketing or promotion; or
   d) any other item which (in our sole and absolute discretion) interferes with the safe and/or effective operation of the Summit.

2. The following behaviour is prohibited from the Summit:
   a) unauthorised merchandising;
   b) any behaviour deemed by us to be illegal, indecent, inappropriate, offensive, disturbing, infringing, unsanitary, containing political or promotional messages, causing nuisances to other participants, our personnels or helpers, or affecting the operation, order or safety of the Summit; or
   c) any other act which (in our sole and absolute discretion) interferes with the safe and/or effective operation of the Summit.

3. We may, at our sole and absolute discretion, without liability or compensation to any party, revoke attendance eligibility of, refuse admission to, or remove from the Summit, any person who in our sole and absolute discretion:
   a) fails to comply with any provisions of these Terms; or
   b) represents a security risk, nuisance or annoyance to the running of the Summit. 

4. You shall at all times during the Summit comply with all reasonable instructions by us, our personnels or helpers.

1. We reserve the right to modify, vary and change these Terms at any time at our sole and absolute discretion. Such modifications, variations and/or changes to the Terms shall be effective upon the posting of an updated version on this webpage. You agree that it shall be your responsibility to review these Terms regularly and your attendance at the Summit (after changes have been made to the Terms) constitute your acceptance of the revised Terms.

1. We reserve the right to change, modify, or alter any aspect of the Summit, without prior notice or any compensation to any party. This Website will be promptly updated to reflect any changes, modifications or alterations, and we will use our best efforts to provide you with reasonable notice prior to any such changes, modifications or alterations take effect.

2. Without limitation to the foregoing, we may, at any time and for any reason, at our sole and absolute discretion, without prior notice or any compensation to any party:
   a) make alterations to the agenda, speakers, venue, dates, timings, schedule, topics and contents of the Summit and/or the Activities; and/or
   b) cancel, suspend, interrupt or postpone the whole or any part of the Summit.

1. All contents presented during the Summit, including but not limited to any presentations, materials and recordings, are protected by copyright and/or other intellectual property rights under the applicable laws and regulations. You shall not record, distribute or reproduce any Summit content without our prior written permission.

2. All right to the items and/or contents of, arising from or concerning the Summit, including but not limited to the name and logo of the Summit, belong to us, including any commercial rights and intellectual property rights thereof. Nothing in these Terms will act to license or transfer any of our rights to you.

1. Taking photographs, videos or sound recording of a limited part of the Summit is only allowed for your personal use.  For the avoidance of doubt, any photography, video shooting and sound recording at the Summit for commercial purpose or use is prohibited.

2. You confirm and agree that we (and any personnel or entity designated by us (the “Designated Entity”)) have the right to:
   a) take photographs, screen captures, videos and/or sound recordings of you a when you are participating in the Summit;
   b) copy and use these photographs, screen captures, videos and/or sound recordings that contain your image, appearance (actual or simulated likeness) and/or voice for any purposes, including but not limited to the marketing and promotion of us, the Summit, the New World Group and/or the Designated Entity and/or any other future activities, merchandise and/or services of us, the Summit the New World Group and/or the Designated Entity which may appear on the websites, social media platforms, publications, etc. of us, the Summit, companies under New World Group and/or the Designated Entity, without making any payment or providing any compensation to any person. 

3. For the avoidance of doubt, we shall have the sole and absolute ownership of the above materials (including but not limited to intellectual property rights) and you agree to waive and release any claims you may have related to the use of such recorded media of you at the Summit, including, without limitation, any right to inspect or approve the photographs, videos or sound recordings of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such recorded media.

1. By registering for the Summit, you agree that your personal information or personal data as stated in the Registration Form and provided by you during the Summit will be collected, used and disclosed by us (including our service provider(s)) for the purpose of the Summit. Your personal information may be shared to third party(ies) in accordance with the PICS, including but not limited to Invest Hong Kong  and certain categories of sponsors of the Summit as listed in (https://www.onepointfivesummit.com/event-sponsors), subject to your consent, for its/their direct marketing purposes.
    

1. To the fullest extent permitted by the applicable law, you shall agree to waive, release, indemnify, relinquish and hold us, NWD, our and/or NWD’s directors, officers, employees, subcontractors, agents or similar persons harmless from:
   a) all liability for loss, injury, damage, cost, expense, fee claim or demand howsoever caused, incurred or sustained during the course of, in connection with or as a result of any matters related to these Terms and/or the Summit;
   b) all indemnities, warranties, representations, terms and conditions (whether express or implied); and
   c) any actual or alleged indirect loss or consequential loss howsoever arising suffered by you or any loss of profits, anticipated profits, savings, loss of business revenue, loss of business, loss of opportunity, loss of goodwill, or any other type of economic loss (whether direct or indirect).

2. We shall not be responsible for any accidents, personal injuries, death, loss or damage of properties howsoever caused to you as a participant to the Summit. In any event, you expressly waive any claims, litigations, proceedings or similar procedures against us for any personal injury, death, or loss or damage to property irrespective of whether arising from or in connection with your participation in the Summit to the extent permissible under the law. For the avoidance of doubt, this provision shall not limit or exclude our liability for any legal responsibility arising from negligence resulting in the participants' death or personal injury.

3. You agree to indemnify and hold us, NWD, our and/or NWD’s directors, officers, employees, subcontractors, agents or similar persons harmless from any losses or liabilities (including any third-party claims) caused to us due to any of your actions or inactions.

1. We are not liable for any delay or failure to perform these Terms (including hosting the Summit) to the extent such delay or failure is caused by any Force Majeure Event.  For these Terms, “Force Majeure Event” means any circumstance outside of our reasonable control, and includes by way of example only the following:
   a) acts of God, flood, drought, earthquake or other natural disaster;
   b)epidemic or pandemic;
   c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
   d) any law or any action taken by a government or public authority;
   e) collapse of buildings, fire, explosion or accident;
   f) any labour or trade dispute, strikes, industrial action or lockouts;
   g) non-performance by suppliers or subcontractors;
   h) interruption or failure of any utility or public transportation service in Hong Kong;
   i)any event outside of our control that has an adverse effect on the Summit, including:
      i)any public demonstration or protests; ori) any public demonstration or protests; or
      ii)any governmental action that has a material adverse effect on the Summit; and
   j)any other circumstance outside of our control that leads us to believe that the Summit cannot be safely or effectively hosted, or where significant changes would need to be made to the Summit in order for it to be hosted.

1. We shall have the right to interpret these Terms in our sole and absolute discretion. In case of disputes, our decision shall be final, conclusive and binding.

2. Save for you (as the Summit registrant and/or attendee), us (as the Summit organiser) and/or NWD, no other person shall have any rights under the Contracts (Rights of Third Parties) Ordinance (Cap.623 of the Laws of Hong Kong) to enforce any term of these Terms or to enjoy the benefits as set out in any term of these Terms.

3. These Terms are governed by the laws of the Hong Kong Special Administrative Region (“Hong Kong”) of the People’s Republic of China, and any disputes arising out of these Terms are subject to the exclusive jurisdiction of the courts of Hong Kong.
